THIS PRIVACY POLICY (THIS “POLICY”) DESCRIBES AIRLOOM LIFESTYLE PRIVATE LIMITED’S (“We”, “Us”, “Company” or “Our”) POLICIES AND PROCEDURES FOR COLLECTION, USE, STORAGE, DISCLOSURE AND PROTECTION OF YOUR PERSONAL INFORMATION, INCLUDING, BUT NOT LIMITED TO, PERSONAL OR SENSITIVE PERSONAL INFORMATION PROVIDED BY YOU WHILE USING AND/OR ACCESSING THE PLATFORM AND/OR PURCHASING ANY PRODUCT FROM THE PLATFORM.                 

 IF YOU ACCESS OR USE THE PLATFORM IN ANY FORM, YOU HEREBY UNEQUIVOCALLY CONSENT TO THIS POLICY AND AGREE TO THE ACCESS, USE, STORAGE AND TRANSMISSION OF YOUR PERSONAL DATA / INFORMATION AS PER THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT PROVIDE US PERSONAL INFORMATION OR WITHDRAW THE CONSENT TO PROVIDE US WITH ANY OF YOUR PERSONAL INFORMATION AT ANY POINT IN TIME, WE SHALL HAVE THE OPTION NOT TO PROVIDE THE BENEFITS, PRODUCT OR THE PLATFORM FOR THE PURPOSE OF WHICH THE SAID PERSONAL INFORMATION WAS SOUGHT. PLEASE FURTHER NOTE THAT WITHDRAWAL OF CONSENT BY YOU WILL NOT DIMISH AND/OR AFFECT OUR RIGHTS AND/OR OBLIGATIONS UNDER THE APPLICABLE LAWS. THE TERMS OF USE OF JOLENE FORM AN INTERGRAL PART OF THIS PRIVACY POLICY. ANY TERMS DEFINED IN THE TERMS OF USE SHALL HAVE THE SAME MEANING FOR THE PURPOSES OF THIS POLICY.

THIS POLICY HAS BEEN ADOPTED IN ACCORDANCE WITH THE INFORMATION TECHNOLOGY ACT, 2000 AND THE DATA PROTECTION RULES AND REGULATIONS OF INDIA. YOUR USE OF THE PLATFORM WILL BE GOVERNED BY THIS POLICY IN ADDITION TO THE TERMS OF SERVICE AS APPLICABLE

1. Your Information

a. Information You Give Us: To create an account with Us and use Our Platform, We may collect the following information from you: Identification information: Full name including First and last name, date of birth, gender, phone number, email, billing address, delivery / shipping address, and other information necessary to verify your identity and to successfully provide Our Platform to you including to enable delivery, sale and purchase of products by you on the Platform.
b. Information Collected Automatically or From Others

i. We may collect certain information automatically when you use the Platform or place an order / request on the Platform.  This information may include your Internet protocol (IP) address, user settings, cookie identifiers, mobile carrier, and other unique identifiers, details about your browser, operating system or device, location information, Internet service provider, pages that you visit before, during and after using the Platform, information about the links you click, and other information about how you use the Platform including your purchase and return history. In addition, We may automatically collect data regarding your use of Our Platform, such as the types of content you interact with and the frequency and duration of your activities, purchases, refunds, returns, etc. 
ii. We, as well as third parties that provide content, advertising, or other functionality on the Platform, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Platform. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow Us and Our partners to record certain pieces of information whenever you visit or interact with Our Platform.

For example, if you access Our Platform through a third-party application, such as an app store, a third-party login service, or a social networking site, We may collect information about you from that third-party application that you have made public via your privacy settings. This supplemental information allows Us to verify information that you have provided to Us and to enhance Our ability to provide you with information about Our business, products, and Platform.

  We may use and share the information including your personal data provided by or collected from you in the following ways, viz: Fulfil Our contract with you and
provide you with Our services, such as:
a. To facilitate deliveries of the products ordered by you on the Platform including for your return requests;
b. To provide the Platform to you;
c. To provide you the various products and services offered by Jolene from time to time;
d. Managing your information and Your Account;
e. Providing access to certain areas, functionalities, and features of Our Platform including to offer promotional schemes and other marketing offers to you;
f. Communicating with you about your Account, activities on Our Platform, your purchases and returns, offers, schemes, marketing plans, and policy changes;
g. Undertaking activities to verify or maintain the quality or safety of Our Platform;
h. Processing your financial information and other payment methods for purchase of products on the Platform, return, etc;
i. For delivery of products / items including any return requests placed by you;
j. For a smooth customer experience and journey including to enhance the customer experience including auto-filling details for future purchases, sending you push notifications, etc.
k. To respond to your queries or concerns including to provide customer support services to you;
l. For promotional, advertising, analytics and marketing
m. Allowing you to register for events, offers, schemes, etc
n. To send you communications, SMS, messages and contact you over call or otherwise, with respect to your activities on the Platform, your purchases and
returns and about the various marketing and promotional offers
Provide you with additional items and products, such as:
a. Developing new product lines and verticals;
b. Furnishing you with customized materials about offers, products, and services and offers that may be of interest, including new items, new launches or
products;
c. Auditing relating to interactions, transactions and other related activities; and
d. Other purposes you consent to, are notified of, or are disclosed when you provide personal information, including but not limited to:
i. We may use technologies considered automated decision making or profiling. We will not make automated decisions about you that would significantly
affect you, unless such a decision is necessary as part of a contract We have with you, We have your consent, or We are permitted by law to use such
technology. You may escalate any concerns you have by contacting Us as per the details under the Terms of Use.
ii. We may use personal information and other data about you to create de-identified and aggregated information, such as de-identified demographic
information, de-identified location information, information about the computer or device from which you access Our Platform, or other analyses We create.
iii. Our Platform may offer various tools and functionalities. For example, We may allow you to provide information about your friends or family for referral. Our
referral services may allow you to forward or share certain content with a friend or colleague, such as an email inviting your friend to use Our Platform or
shop on Our Platform.
iv. We, as well as third parties that provide content, advertising, or other functionality on the Platform, may use cookies, pixel tags, local storage, and other
technologies to automatically collect information through the Platform. Our uses of these Technologies fall into the following general categories:

• Your browsing activity may be tracked across different websites and different devices or apps. For example, We may attempt to match your browsingactivity on your mobile device with your browsing activity on your laptop. To do this Our technology partners may share data, such as your browsingpatterns, geo-location and device identifiers, and will match the information of the browser and devices that appear to be used by the same person.
• We may use third party APIs and software development kits (“SDKs”) as part of the functionality of Our Platform. APIs and SDKs may allow third parties including analytics and advertising partners to collect your personal information for various purposes including to provide analytics services and content that is more relevant to you.

Analyse and improve Our Platform pursuant to Our legitimate interest, such as:
a.  Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity or misuse of the Platform or abuse of any
policy/ies of Jolene, and prosecuting those responsible for that activity;
b. Measuring interest and engagement in Our Platform and the products / items offered on Our Platform and short-term, transient use, such as contextual
customization of ads;
c. Undertaking research for new launches, introducing new product categories, etc;
d. Researching and developing products, services, marketing or security procedures to improve their performance, resilience, quality, reliability or efficiency of Our Platform or the items / products offered on Our Platform;
e. Improving, upgrading or enhancing Our Platform or Our products / items;
f. Developing new products and product lines;
g. Ensuring internal quality control;
h. Verifying your identity and preventing fraud;
i. Debugging to identify and repair errors that impair existing intended functionality;
j. Enforcing Our terms and policies; and
k. Complying with Our legal obligations including any requests from any legal, statutory, regulatory, self-regulatory or other authority including any banking or
payment channels, protecting your vital interest, or as may be required for the public good.
3. Sharing and Disclosure of Information
We may disclose your information to third parties including third party service providers for the purposes mentioned under Section 2 above, inter alia, in order to
perform KYC checks, provide you with customer support facilities, to deliver products, to pick-up products, to return products, comply with Our legal obligations
including to enforce Our Terms of Use, to facilitate Our marketing and advertising activities, to conduct analysis, to provide you services, to facilitate services of the
Platform for you, to send notifications, reminders and/or notifications, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to the Platform and to avail services from third parties for data analysis and market research.

In the event the Company is merged with or acquired by another company or in case of re-organization or re-structuring of business, We and Our affiliates will share your Personal Information, wholly or in part, with another business entity.

Additionally, We will share your information with third parties only in such manner as described below: 
a. We may share your information with third parties including government, statutory, regulatory, third-party delivery partners/service providers/agents/partners, etc. and in such an event, the third parties’ use of your information will be bound, among other things, with obligation to protect the confidentiality of your information.
b. We may store information in locations outside the direct control of the Company (for instance, on servers or databases co-located with hosting providers) and your use of the Platform shall constitute consent for the same.
c. We may access, preserve, and disclose any information We store associated with you to external parties if We, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, Our or others’ rights, property, or safety; enforce Our policies or contracts; collect amounts owed to Us; or assist with an investigation or prosecution of suspected or actual illegal activity.
d. We may disclose your information, to any member of Our related or group companies including but not limited to, Our subsidiaries, and your use of the Platform shall constitute consent for the same.
e. We may disclose your information if We are under a duty to do so in order to comply with any legal obligation or an order from the government and/or a
statutory authority, or in order to enforce or apply Our Terms of Service or assign such information in the course of corporate divestitures, mergers, or to protect
the rights, property, or safety of Us, Our users, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
You may have interest or intention of availing such services or a general query with respect to the products available on / through the Platform. You thereby give Us the unequivocal right to:
a. Contact you through various mediums, including but not limited to phone calls, emails, etc. or make a phone call to you to discuss your query or request;
b. Contact you through phone or message notwithstanding the fact that you may have registered under the Telecom Regulatory Authority of India regulations as a fully blocked or a partially blocked customer. It is further clarified that We shall only make solicited phone calls or messages
c. Share the contact details provided by you with the service provider or agent or representative available on or through the Platform who may be in a position to
sufficiently answer or respond to your query, including but not limited to third party service providers.
4.Storage, Security and Retention
a. You acknowledge that all information processed by Us may be transferred, processed, and stored anywhere in the world, including but not limited to, outside
India, which may have data protection laws that are different from the laws where you live. We have taken appropriate safeguards to require that your personal
information will remain protected and require Our third-party service providers and partners to have appropriate safeguards as well.
b. We assume no liability for any disclosure of information due to errors in transmission, unauthorised third-party access or other acts of third parties, or acts or omissions beyond Our reasonable control and you agree that you will not hold Us responsible for any breach of security unless such breach has been caused
as a direct result of Our gross negligence or wilful default.
c. In using the Platform, you accept the inherent security implications of data transmission over the internet and the world wide web cannot always be guaranteed as completely secure. Therefore, your use of the Platform will be at your own risk.
d. We will use and retain your information for such periods as necessary to comply with any applicable laws, Our legal obligations, resolve disputes, record
keeping and enforce this agreement.
e. We also store the personal information We receive as described in this Privacy Policy for as long as you use Our Platform or as necessary to fulfil the
purpose(s) for which it was collected, provide Our Platform / products, resolve disputes, establish legal defences, conduct audits, pursue legitimate business
purposes, enforce Our agreements, and comply with applicable laws.
5. Non- Disclosure of Information
You may choose not to provide identifiable information through the Platform, in which case you may not be allowed to access certain features / parts of the Platform and/or purchase the products / items on the Platform. If you are a registered user, you may update, edit or correct your account information and email preferences at any time by logging in to your account.
Please note that if you provide any feedback or testimonials to Us with respect to Our Products or the Platform or otherwise, the same shall not be subject to this
Policy and We will be able to use and publicize them as per Our sole discretion.
6. Other Restrictions
The Platform are not directed to children under 18 (or other age as required by local law), and We do not knowingly collect personal information from children. If you learn that your child has provided Us with personal information without your consent, you may contact Us as set forth below. If We learn that We have collected any personal information in violation of applicable law, We will promptly take steps to delete such information and terminate the child’s account.
7. Links to Third Party Sites
Our Platform may, contain links to and from the Platforms of Our partner networks, affiliates and other third parties. The inclusion of a link does not imply any endorsement by Us of the third-party Platform, the Platform's provider, or the information on the third-party Platform. If you follow a link to any of these Platforms, please note that these Platforms may be governed by their own privacy policies, and We disclaim all responsibility or liability with respect to these policies or the Platforms. Please check these policies and the terms of the Platforms before you submit any information to these Platforms.
8. Your Rights
We never sell your personal information to anyone. Subject to this Privacy Policy, to the maximum extent required by applicable law, you may have the right to:
a. Request correction of your personal information where it is inaccurate or incomplete. In some cases, We may provide self-service tools that enable you to
update your personal information or We may refer you to the controller of your personal information who is able to make the correction.
b. Request deletion of your personal information, subject to certain exceptions prescribed by law.
c. Withdraw your consent to Our processing of your personal information.
d. If you would like to exercise any of these rights, please log into your account and contact Us as set forth below. We will process such requests in accordance with applicable laws. To protect your privacy, We will take steps to verify your identity before fulfilling your request.
9. Severability and Exclusion
We have taken every effort to ensure that this Policy adheres with the applicable laws. The invalidity or unenforceability of any part of this Policy shall not prejudice
or affect the validity or enforceability of the remainder of this Policy. This Policy does not apply to any information other than the information collected by the
Company through the Platform. This Policy shall be inapplicable to any unsolicited information you provide Us through this Platform or through any other means or
through public channels. This includes, but is not limited to, information posted in any public areas of the Platform. All unsolicited information shall be deemed to be
non-confidential, and the Company shall be free to use and/ or disclose such unsolicited information without any limitations. This Policy will also not apply to any non-personal information and We shall have the sole right to process such non -personal information as per Our requirements and as We deem fit in Our sole discretion.
